Terms of Service

1. Acceptance of terms

By accessing or using Jobulary 360 ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including administrators, raters, and assessment subjects.

2. Description of service

Jobulary 360 is a SaaS platform that enables organisations to run structured 360-degree feedback and assessment programmes. Features include multi-rater feedback collection, AI-generated coaching reports, PDF exports, and subscription-based billing.

3. Account registration

To use the Service you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

You must be at least 18 years old to create an account and use the Service.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Upload data that you do not have the right to share
  • Attempt to reverse-engineer, decompile, or tamper with the platform
  • Use the Service to harass, intimidate, or discriminate against employees
  • Misrepresent rater responses or manipulate assessment results
  • Resell or sublicense access to the Service without our written consent

5. Subscription and billing

Access to paid features requires an active subscription. Subscriptions are billed monthly and renew automatically unless cancelled. All prices are displayed exclusive of applicable taxes.

We offer a 14-day free trial on new accounts. No credit card is required to start a trial. At the end of the trial, you must subscribe to continue using paid features.

Payments are processed by Stripe (for USD billing) or Razorpay (for INR billing). We do not store payment card details on our servers.

We offer a 14-day money-back guarantee on new subscriptions. Refund requests must be submitted within 14 days of the initial charge by emailing hello@jobulary360.com.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date. We do not provide pro-rated refunds for partial months.

7. Data and privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service you confirm that you have read and understood it.

You retain ownership of all data you upload to the Service. By uploading employee data, you confirm that you have appropriate consent or lawful basis to process that data under applicable privacy laws (including GDPR, PDPA, or other applicable regulations).

8. AI-generated content

The coaching narratives generated by Jobulary 360 are produced using OpenAI's GPT-4o model and are intended as a starting point for development conversations — not as a definitive assessment of any individual. We make no guarantee as to the accuracy or completeness of AI-generated content. Organisations should use AI reports as one input among many, not as sole basis for employment decisions.

9. Intellectual property

The Jobulary 360 platform, including its code, design, branding, and pre-built competency frameworks, is our intellectual property and is protected by applicable copyright and trademark law. You may not copy, reproduce, or redistribute any part of the platform without our written consent.

10. Limitation of liability

To the fullest extent permitted by law, Jobulary 360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Service availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform maintenance that temporarily interrupts the Service. We will endeavour to provide advance notice of scheduled downtime where possible.

12. Changes to these terms

We may update these Terms from time to time. We will notify active account holders of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first, and thereafter through binding arbitration or courts of competent jurisdiction.
